TERMS AND CONDITIONS

This legal agreement establishes the binding terms governing your relationship with GameForge Studio and defines mutual responsibilities, obligations, and limitations.

Legal Agreement Framework

These Terms and Conditions constitute a legally binding agreement between you (the "Student" or "User") and GameForge Studio (the "Company," "we," "us," or "our"). By accessing our website, enrolling in courses, or utilizing any of our educational services, you acknowledge that you have read, understood, and agree to be bound by these terms in their entirety.

This agreement supplements and works in conjunction with our Terms of Service, Privacy Policy, and other applicable policies. In case of conflict between documents, these Terms and Conditions shall take precedence regarding legal obligations and dispute resolution matters.

Important Notice: If you do not agree with any provision of these Terms and Conditions, you must immediately discontinue use of our services and may request a refund according to our refund policy.

User Obligations and Legal Responsibilities

You agree to comply with all applicable laws, regulations, and ordinances of Cyprus, the European Union, and your local jurisdiction while using our services.

Professional Conduct

Maintain professional standards in all interactions, communications, and course participation, treating instructors and fellow students with respect and courtesy.

Prohibited Activities

Refrain from any illegal activities, harassment, discrimination, copyright infringement, or actions that may harm the reputation or operations of GameForge Studio.

2. Content Guidelines and Restrictions

Intellectual Property Respect

Respect all intellectual property rights, including but not limited to copyrights, trademarks, patents, and trade secrets of GameForge Studio and third parties.

Content Usage Limitations

Use course materials solely for personal educational purposes. Commercial use, redistribution, or sharing of proprietary content is strictly prohibited without written consent.

Age Restrictions

Users must be at least 16 years old to participate independently, or have verifiable parental/guardian consent and supervision for younger participants.

3. Indemnification Obligations

You agree to indemnify, defend, and hold harmless GameForge Studio, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • • Your use or misuse of our services and educational materials
  • • Your violation of these Terms and Conditions or any applicable laws
  • • Your infringement of any intellectual property or privacy rights
  • • Any content you submit, upload, or transmit through our platform
  • • Your negligent or wrongful conduct during course participation

Disclaimers, Warranties, and Liability Limitations

4. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GameForge Studio provides all services and content "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We specifically disclaim all warranties including, but not limited to, merchantability, fitness for a particular purpose, non-infringement, and those arising from course of dealing or usage of trade.

5. Service Availability

We do not warrant that our services will be uninterrupted, error-free, or completely secure. Technical difficulties, maintenance, or circumstances beyond our control may affect service availability.

6. Educational Outcomes

While we strive to provide high-quality education, we cannot guarantee specific learning outcomes, job placement, salary levels, or career advancement as results may vary based on individual effort and market conditions.

7. Third-Party Content

We are not responsible for the accuracy, reliability, or legality of third-party content, software, or services referenced or integrated into our courses.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, in no event shall GameForge Studio, its affiliates, directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • • Loss of profits, revenue, or business opportunities
  • • Loss of data, information, or educational progress
  • • Business interruption or operational delays
  • • Cost of substitute services or alternative education
  • • Damage to reputation or professional standing
  • • Emotional distress or mental anguish
  • • Loss of use, goodwill, or anticipated savings
  • • Any other intangible losses or damages

Liability Cap: Our total liability for any claims arising from these terms or your use of our services shall not exceed the total amount paid by you to GameForge Studio in the twelve (12) months preceding the claim.

9. Force Majeure Provisions

GameForge Studio shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government regulations, labor disputes, or technical failures of third-party services.

Legal Framework and Dispute Resolution

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to conflict of law principles.

The courts of Larnaca, Cyprus shall have exclusive jurisdiction over any disputes arising from or relating to these terms or your use of our services.

11. Alternative Dispute Resolution

Before initiating formal legal proceedings, parties agree to attempt resolution through good faith negotiations and, if necessary, mediation administered by a qualified Cyprus-based mediation service.

12. Severability Clause

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remainder of these terms shall remain in full force and effect.

13. Terms Modification Policy

GameForge Studio reserves the right to modify these Terms and Conditions at any time. Material changes will be communicated to active users with 30 days advance notice. Continued use of our services after the effective date constitutes acceptance of modified terms.

14. Final Provisions

Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Terms of Service, constitute the entire agreement between you and GameForge Studio regarding your use of our services.

Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations at any time without notice.

Waiver

No waiver of any provision of these terms shall be deemed a further or continuing waiver of such provision or any other provision.
